Downloading a file (from a P2P network) for private use is perfectly legal as long as there is no lucrative or collective use of the downloaded copy, as said on SlashDot. More info and links there. In theory it is not the gun that kills, it is the people that load the gun, aim and pull the trigger.
But in most Europe gun ownership is restricted and you aren't allowed to produce and sell your guns to everybody or you aren't allowed to collect guns.
So, even it is obvious that P2P software in itself is not a "crime", it is also obvious that almost everybody uses it for breaking the copyright laws.
About downloading copyrighted stuff for "personal use" it is again a thin line, considering the size of the "personal use" multiplied for all the internet users. Same for the "lucrative" side, if you collect a whole movie archive from P2P you are "lucrating" in the form of saving lots of money.
All these "thin lines" are stuff that can change as soon as a government changes and different policies are introduced. Laws in democracies are made by the parliament.
