Respetado señor Presidente: Como es de su conocimiento, desde el 2 de septiembre de 2004 Bogotá le propuso al Gobierno Nacional participar en la construcción de la estrategia nacional de negociación del TLC y ser parte del equipo negociador, con el ánimo de contribuir al éxito del proceso y a la defensa de los intereses regionales. Lamentablemente el Gobierno Nacional no aceptó nuestra oferta y hemos asistido sólo como observadores a las distintas rondas. El 23 de noviembre de ese año entregamos a los negociadores nacionales nuestras propuestas de defensa básica del interés regional en cada uno de los temas y nuestras aspiraciones de acceso real al mercado estadounidense. Por desgracia, nunca obtuvimos respuesta del Gobierno Nacional. Cumplidas 13 rondas y luego de que Perú protocolizó un cierre formal de las negociaciones con Estados Unidos, el país ha sido notificado por el Ministro de Comercio, Industria y Turismo, Jorge Humberto Botero, de que se intentará concluir el proceso a partir del próximo 23 de enero en Washington. Sin lugar a dudas, el cierre inmediato de las negociaciones sólo será posible sobre la base de aceptar, en el caso colombiano, un TLC muy similar al suscrito por Perú. Con todo respeto, señor Presidente, me permito manifestarle que de aceptarse un TLC igual al suscrito por Perú se desatenderían los intereses básicos presentados por Bogotá en noviembre de 2004, se pondrían en grave riesgo importantes sectores productivos nacionales y serían muy escasas las oportunidades de creación de nuevos empleos productivos para los colombianos. En particular, señor Presidente, quiero llamar la atención sobre los siguientes aspectos neurálgicos: 1. Si se acepta, como en el caso del Perú, liberar todas las importaciones agrícolas -altamente subsidiadas en Estados Unidos-, desmontar el Sistema Andino de Franjas de Precios y no se sustituye éste para los bienes sensibles por una Salvaguardia Especial Agropecuaria de carácter permanente, en pocos años habrá quebrado buena parte del sector agropecuario. No es posible sustituir la protección arancelaria con subsidios agrícolas porque sería competir con el Tesoro de Estados Unidos. Al contrario, el TLC traerá una reducción importante de los ingresos tributarios de la nación de más de 300 millones de dólares anuales. En esas condiciones se sometería a mayor riesgo la seguridad alimentaria de los bogotanos, se incrementarían las migraciones a Bogotá y se harían aún más difíciles las condiciones para la ocupación pacífica y productiva del campo. 2. En el mismo sentido, permitir que al mercado nacional entren los trozos de pollo que son considerados en Estados Unidos como desechos, sería condenar a la ruina a la industria avícola. 30 por ciento de los 250 mil empleos que genera esa industria están localizados en Bogotá y la región aledaña. 3. Mientras tanto, Estados Unidos no adopta compromisos efectivos para facilitar el acceso a su mercado mediante la aceptación de convalidación de normas sanitarias y fitosanitarias. 4. Aumentar la protección al monopolio de las industrias farmacéuticas innovadoras, más allá de los compromisos adquiridos por Colombia en la OMC, conducirá a una elevación de los precios de los medicamentos. Por ejemplo aceptar, como lo hizo Perú, extender las patentes por demoras injustificadas en el otorgamiento de la licencia le costará a los usuarios bogotanos un sobreprecio de 46 millones de dólares en el año 2030; condicionar el registro sanitario a la existencia o no de la patente, 62 millones de dólares en el mismo año; y un monto igual conceder la protección de los datos de prueba. Esto significaría la negación del acceso a la salud a miles de bogotanos o la reducción de la inversión social en otras áreas prioritarias del Distrito Capital. 5. En el sector de los servicios, que cubre el 69 por ciento del PIB de Bogotá, nuestras expectativas de aprovechar el TLC para exportar servicios empresariales y profesionales se verían restringidas por no pactar visas temporales para empresarios, profesionales y trabajadores, y por carencia de homologación de títulos profesionales, entre otras restricciones no desmontadas por Estados Unidos. Conozco, señor Presidente, la importancia de establecer un tratado comercial sólido y estable con Estados Unidos, nuestro principal socio comercial. No estamos contra los tratados, queremos ser bien tratados. En atención a lo expuesto y a los estudios que Bogotá ha presentado al Gobierno Nacional sobre las negociaciones del TLC, en mi condición de ciudadano y de Alcalde Mayor de Bogotá respetuosamente le solicito, señor Presidente, postergar la firma del Tratado hasta tanto no existan garantías plenas para Colombia y, en especial, para los derechos y el bienestar de los bogotanos y bogotanas. El país requiere un TLC sustancialmente distinto al firmado por Perú. La estructura productiva, así como las condiciones sociales y políticas de Colombia son muy diferentes de las de esa nación hermana. En subsidio de lo anterior, reitero la propuesta presentada en marzo del año pasado por Bogotá de que Colombia solicite a Estados Unidos la renovación de las preferencias arancelarias ATPDEA. Esas preferencias consagran el interés estratégico de Estados Unidos de cooperar con Colombia en la lucha contra el narcotráfico y compensan, en parte, el costo nacional en la infatigable tarea común de combate al narcotráfico. Estoy seguro que el Gobierno y el Congreso de Estados Unidos comprenderán las razones así expresadas por Colombia. La terminación del ATPDEA, en diciembre de este año, no puede convertirse en una espada de Damocles para condicionar la firma del TLC. En cualquier caso, es más factible renovar el ATPDEA que aprobar el TLC, dados los antecedentes de la aprobación del TLC firmado con Centroamérica y República Dominicana. Sólo si es renovado el ATPDEA las negociaciones del TLC podrán transcurrir hasta que las dos naciones encontremos un equilibrio que beneficie mutuamente a nuestros pueblos. Este es un mensaje de alerta sobre irregularidades en cajeros electronicos. Hoy 30 de noviembre de 2005 al intentar una transaccion en un cajero de Colmena de villa del prado encontre esta “cubierta” sobre la ranura normal del cajero, la cual impide que la tarjeta sea devuelta. Debajo de la misma existia un letrero aparentemente con logo de colmena con “Instrucciones” en caso de que la tarjeta no sea devuelta, de marcar tres veces el numero de la clave y de que si aun no es devuelta, la misma seria regresada en 24 horas a su oficina. Me parecio sospechosa la situacion y removi la cubierta, la cual estaba adherida con cinta de doble superfice pegante, la cual salio facilmente, mi tarjeta estaba ahí. Tambien removi el “instructivo” y acudi a una oficina Colmena para reportar el caso. Ello lo enviaron al departamento de saguridad. Adjunto fotos. Ojo a situaciones irregulares , sobre todo en epocas de primas navidenas, no sea que otros sean los que las disfruten. Saludos Guillermo Rodriguez
