Judge rules accused killer with low IQ must be freed; can't be competent

LAWRENCE -- A judge has ruled that a Lawrence man with an extremely low IQ must be set free because he will never be competent to stand trial for the 2000 murder of a Salem, N.H., man outside a Lawrence bar.

William Beal, of Salem, was beaten to death outside the Calumet Tavern. Eric Falardeau, 29, was charged with second-degree murder in Beal's death.

Lawrence Superior Court Judge Howard Whitehead on Tuesday released Falardeau, who has a long police record, because his learning disabilities prevented him from assisting in his own defense, according to published reports.

Unlike defendants who are found incompetent to stand trial, Falardeau is not mentally ill however, his IQ is borderline mentally retarded, according to reports.

If he can't be tried and can't be hospitalized for mental illness, Whitehead said he had no choice but to release Falardeau, according to reports. Falardeau has already spent more than 1,000 days locked up since his arrest.

Over the years, prosecutors had maintained that Falardeau, who graduated from Lawrence High School in 1997 ranking 208 out of 300 students, could be restored to competency with the right program, according to reports.

Falardeau had been drinking the night he fought with Beal, a 39-year-old father of four. Beal kicked him in the behind and punched Falardeau before Falardeau got the better of him in the fight.

They should place him in an "Guatanamo Bay" like facility until they can figure out where to place him or what to do with him, as a precautionary measure. Releasing him into the public is dereliction of duty in my eyes. It's just a matter of time before he strikes another person down. If he ranked 208 out of 300 in his graduating class yet is considered to have a very low IQ, then I ask "Are all the other students in his class in the same situation? If so, how the heck did they graduate? Something very wrong here.

funny. that's EXACTLY what i said. it's telling the rest of the class that came after him that it's ok to commit any crime whatsoever!!!!!!!!!!! is this justice??????? this angers me greatly. it's teaching the whole country that if you can prove you're stupid, it's then alright to commit murder!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
