ENDLESS OCEAN CRUISE GIVEAWAY

1. Eligibility. NO PURCHASE NECESSARY TO ENTER OR WIN; PURCHASE WILL NOT IMPROVE ODDS OF WINNING. SWEEPSTAKES OFFERED AND OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, EXCLUDING PUERTO RICO, WHO ARE OVER THE AGE OF 18. IF YOU ARE NOT A RESIDENT OF THESE AREAS OR FAIL TO COMPLETE YOUR ENTRY IN THE FORMAT DESIGNATED BELOW, YOU ARE NOT ELIGIBLE TO WIN A PRIZE. Nintendo of America Inc. is the sponsor ("Sponsor") of this Endless Ocean Cruise Giveaway ("Sweepstakes"). Directors, officers and employees of Sponsor, its parent and any of their affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate family members of each (parents, children, siblings or spouse) and those residing in the same household, whether related or not, are not eligible to enter. All applicable federal, state and local laws and regulations apply. Offer void where prohibited.

2. Disclaimer. No mechanically or electronically reproduced entries will be accepted. Sponsor, its parent company, and any of their respective subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled, distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communications related malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses, or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the Sweepstakes.
Entry is limited to one entry per person, per day. Only the first entry received each day of the Sweepstakes from an individual will count; subsequent attempts to enter will be disqualified. In the event of a dispute as to any online entry, the account holder of the e-mail address used to enter will be deemed to be the entrant ("account holder" being the natural person to whom the e-mail address is assigned by the relevant internet access provider). Potential winners may be required to show proof of being the account holder.

3. Sweepstakes Period. The Sweepstakes periodshall commence at 12:01 AM Pacific Time on February 6, 2008, and end at 11:59 PM Pacific Time on February 29, 2008 (the "Deadline"). All entries must be received by the Deadline to be eligible to win a prize.

4. Prizes.

Grand Prize Package: Three (3) Grand Prize winners will receive: one (1) 7-day Caribbean cruise vacation for Grand Prize winner and one (1) guest in a balcony stateroom (ARV: $1500. The actual value will vary depending on date and time of travel. If the actual value of any prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor reserves the right to award a prize of equal or greater value in the event of unavailability.) Prize does not include and is exclusive of air fare, government taxes and fees, service charges, onboard expenses and other personal expenditures. Grand Prize winner will be responsible for booking the cruise vacation for him/her and his/her guest through the cruise provider. Cruise must be completed no later than twelve (12) months from Grand Prize winner's receipt of the Grand Prize. The cruise certificates may not be used to pay for incidental or other expenses and may not be sold or otherwise transferred to any other person. It is the Grand Prize winner's and his/her guest's responsibility to provide for any additional expenses not expressly included in the Grand Prize as described herein, including, but not limited to, alcohol, gambling, in-room movies, meals, on board purchases, shore excursions, applicable sales, use, income or other taxes, all airline flights, airport departure taxes, entry/exit fees, any and all applicable passport and visa fees, accident insurance, excess baggage costs, travel insurance, health/medical insurance, service charges, gratuities, taxis, transportation and other incidental costs, and any other services or expense incurred by Grand Prize winner and/or his/her guest aboard the cruise ship that are not already included in the cruise package. The Grand Prize winner and his/her guest must be in possession of a valid picture ID and proof of U.S. citizenship/legal residence satisfactory to Norwegian Cruise Lines Norwegian Cruise Line also recommends that the Grand Prize winner and his/her guest possess valid passports. An adult winner's travel companion must be 18 years of age or older, or if the companion is a minor, the winner must be such minor's parent or legal guardian.
Odds of winning a prize depends upon the total number of eligible entries received. Many will enter, three (3) entrants will win a prize. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER. Prize or prize notification returned as undeliverable or otherwise not claimed within 10 days after delivery of notification will be forfeited. Prize is not transferable. No substitutions or exchanges (including for cash) for the prize will be permitted, except that Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value for any prize. Prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). All taxes and any license, destination and delivery charges are the sole responsibility of each winner.

5. How to Enter. To enter, complete the online entry form provided at http://www.nintendo.com/sweepstakes/EndlessOcean_Sweeps.jsp. Automated entries (including but not limited to entries submitted using any bot, script, macro or a promotion entry service), copies, and third party entries, are not permitted and will be disqualified. Limit one entry per person per day.

6. Winner Selection. Prize winner will be determined by a random drawing from all eligible entries, to be held on or about March 5, 2008 by Sponsor. Winner will be notified by telephone or e-mail on or about 1-2 weeks of the drawing. To claim the prize, the winner should follow the instructions contained in their notification.

7. General.
Winner will be required to complete and return an Affidavit of Eligibility and Release and a W-9 Form (Taxpayer Identification Number and Certification Form) within seven (7) days of receipt before the prize can be officially awarded. In compliance with US Internal Revenue Service regulations, Sponsor will issue a Form 1099-Misc to all winners receiving a prize valued in excess of $600 (USD), which requires disclosure of the winner’s social security number. The winner remains solely responsible for paying all federal and other taxes in accordance with the laws that apply in your state of residence. Should a winner be deemed ineligible or fail to return the required forms within the time period allowed, an alternate winner may or may not be selected. Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate the Sweepstakes should the administration or security of the Sweepstakes become compromised. By entering the Sweepstakes, you release Sponsor, its parent and their respective subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damage of any kind arising out of or in connection with the Sweepstakes or delivery or misdelivery, acceptance, possession, use of or inability to use the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

8. Use of Winner's Name, Likeness, etc. Except where prohibited by law, entry into the Sweepstakes constitutes permission to use winner's name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded the prize, except where prohibited by law, winner may be required to execute a consent to the use of his/her name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.

9. Affidavit & Release. As a condition of being awarded any prize, winners may be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability. Guest of Grand Prize winner, or their parent or legal guardian if they are a Minor, will also be required to execute an affidavit and release prior to going on the trip with Grand Prize winner. The return of the affidavit and releases of Grand Prize winner and his/her guest shall be the sole responsibility of the Grand Prize winner.

10. Winners List; Rules Request. For a copy of the winners list, send a stamped, self-addressed, business-size envelope between April 1, 2008 and April 30, 2008, to Sponsor at the address listed below. Attn: Nintendo’s Norwegian Cruise Line Sweepstakes Winners List. To obtain a copy of these Official Rules, send a stamped, self-addressed business-size envelope to Sponsor at the address listed in item # 12 below, Attn: Endless Ocean Cruise Giveaway.

11. Miscellaneous. The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the United States. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Sweepstakes or any entrant's participation in the Sweepstakes should unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Sweepstakes or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Sweepstakes as planned. Entrants who violate these Official Rules, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to Sponsor, the Sweepstakes or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Sweepstakes.
