Thoughts about everything

When Copyright strikes back

, , ,

I keep checking the OTOS ( Opera Terms Of Service), and I just found something weird.

For a long time TOS were short, and was kinda ok. I still don’t get why ppl can’t upload videos – since if they want to do so I think ppl would rather upload their stuff to the appropriate sites (Rapidshare and its friends for example). Also for a long time “we” (the users) had our right to copyright our own work.
And today after a few weeks I looked at the OTOS and saw the following:

By uploading Content to Opera's site, you grant Opera an unrestricted, royalty-free, worldwide, irrevocable license to use, reproduce, display, perform, modify, transmit, and distribute such material in any manner, including in connection with Opera's business, and you also agree that Opera is free to use any ideas, concepts, know-how, or techniques that you send Opera for any purpose.

Ok.
So Opera tries to be like FB – and it is a big problem since – Like it or not I really really doubt that OC will ever grow to the size of FB or MS. (In fact that is one of the strongest factors why I am still here)
I think FB was the sneaky one who did the same recently – not sure though and it doesn’t matter.
And I really really don’t like the idea of this paragraph, and I don’t feel like giving unrestricted license to just anybody or ANY place. It is also confusing because what if I already put everything under Creative Common License? (CCL) Than what?
When I do a tutorial, or just upload anything I do it for the community, BUT ALWAYS under some small restrictions (usually under CCL) – such as, linking back to post/my blog, name me, quote me ect.)
And now…
I don’t get it…
Sigh…

That could be quite a legal minefield. Surely, any posts made before the Tos was changed cannot be governed by this amendment? :left:.
And when was the change actually made?

IN the middle of June I think.

But this is a reason I am not going to upload / create certain stuffs, because I don't feel like asking around dozens of mods (And they can be wrong too ) and I don't feel like waiting ages for reply....

Oh well...

Sigh...

:faint:

Sounds a bit disturbing that they changed stuff without notification..

It is not just Opera - everybody keeps doing that it it drives me nuts. At least they could send out a mass-PM that it changed.

Actually there is a site which does that, it is called TOSBack - I'm just looking forward to see Opera community in it...

I didn't know Opera had changed their ToS...
You're right - FB did something similar a while back, but they were forced to change it.

Stomyr 7. July 2009, 09:14

I guess I'm the only one who keeps reading regularly TOS...

In Opera's case it is waaaay too rude for the simple reason of having like 2 million users and a lot of them are "blank users" while the big ones have 10-100 times more...

r♡se 7. July 2009, 11:19

It's good that we have you then

But I agree - they shouldn't have changed it just like that. And definitely not without warning.

Stomyr 7. July 2009, 21:08

They have the right to do that - but in a small community like this it is just nonsense and weird...
