What is discrimination and how to fight it

, , , ,

Unfortunately, in our life, discrimination does exist in different forms almost in all spheres. But no all the people can see discrimination when it’s about a certain attitude towards them. Discrimination can be open (when you are openly gender discriminated) and hidden (when, for example, when only men are required for work, or when you do not fit any age or height requirements).
The most important thing is to see you have become a victim of gender discrimination and do not take such treatment like granted.
Discrimination in the workplace can be shown in following cases:
- when you are refused to get a job because you are a woman;
- when you get fired because you are pregnant;
- when you do not get promotion because you are a woman;
- when you get refusals because of age limitations;
- when you are not allowed to study at the expense of company’s costs just because no one is going to promote you.
Remuneration of labor. Remember that you have a right to equal remuneration for equal work. It means that you have to be paid the same salary as men doing the same job. Do not take difference in salary as granted. If you see that management underpays you, do not be afraid to raise this question. You have right to equal labor remuneration.
Discrimination in the sphere of education. Even in the sphere of education there exists discrimination. For instance, during admission to different department in universities, men get more preference for unknown reasons. Or, vice versa, some professions are associated only with women.
In reality, any person regardless of his gender has a right to get the very profession he wants to, and no one has a right to refuse him. If the results of tests are equal, you have equal chances to be accepted.
Discrimination in human services. Remember, you have a right to get a credit regardless your aim, rent and receiving any other services.
Millions of people all over the world face different types of discrimination every day. There many ways of resisting discrimination. You can read other people’s reviews, comments and even complaints about job discrimination, gender discrimination or any other kind of such attitude or pay attention to some recommendations from professional lawyers. Remember, you have to be able to see and to fight discrimination.
What should you so when facing discrimination?
Suit to the court. This is the most widespread and, probably, the most effective way of fighting discrimination. Though, women who took part in a class action lawsuit against Walmart lost the case (the case of gender discrimination is now called the largest and the most scandalous in the American history).
Applying to the Labor Inspection will help to recover violated rights. But the Labor Inspection doesn’t take part in solving individual disputes, and recommends applying to the court. This organization will help you to fix the fact of discrimination, but won’t recover your rights and compensate losses.
Applying to the public prosecutor's office is a great decision when it’s about workplace discrimination. As practice shows, in some cases this is quite effective way to fight discrimination.
Remember, you should not only know your rights, buy also protect them!

Brian writes: In fact we see job discrimination every day. But sometimes it is so insignificant that we can close eyes and work. But when you don't get salary or your payment is much lower you start thinking about it. I can say that it is very important to go to court and protect yourself. Don't let other people earn when you work.
