Medical Negligence Claims

Claims in professional negligence can be a major issue. Professionals and experts can make mistakes, but in business law, their negligence can cause your business serious problems. Professional negligence covers situations where the defendant has made out as having more than average skills and abilities. The rules embodying professional negligence are the same as the tortuous claims in negligence. It is important to establish a duty of care owed by the defendant to the claimant, and that the defendant is then in breach of that duty, causing damage. Making a claim against people for professional negligence is not an easy task. Many businesses are insured against claims of negligence and others will try to exclude or limit their liability owed in any contracts that they may have with you, leading onto further arguments as to the validity of these clauses.
Medical negligence claim include surgical errors, anesthetic complications, cerebral palsy due to birth trauma and general practitioner cases. Common cases of medical negligence include accident and emergency negligence; often people are discharged with no diagnosis and then go on to suffer further pain, injury or disease. Unfortunately, another common claim is the neglectful treatment of the elderly in care homes - examples can be bruises, cuts or bed sores appearing on patients, lack of hygiene and weight loss. All medical procedures carry risk and patients are usually informed of these risks before they go through with their treatment. If these unfortunate risks do occur then medical negligence cannot be claimed. Only if the standard of care falls below what is expected can there be a case - and the injury or damage caused from this negligence must be evident.

“No Win-No Fee Policy” is really true for medical negligence claims or others claim. The injury has to be assessed and the medical report must be prepared. The court fees and other payments must be paid too. And finally, the no win no fee solicitor should earn something as well.
