Yulia Tymoshenko: latest accusations are Yanukovych’s agony and hysterics Appeal by Yulia Tymoshenko I am appealing to everyone who believes me, who supports me in Ukraine and abroad. I know that you’re putting your hope in me, trusting that together we will free Ukraine from criminal occupation and bring it back to life. I believe this too. I won’t let you down. I have the strength to withstand all the inhuman humiliation, overcome and stand by you to preserve a European and independent Ukraine, to make the changes the country needs. I know that you are as shocked as I am by the new charges announced by the Prosecutor General on January 18, 2013 regarding my participation in the tragic murder of Yevhen Shcherban and illegally obtained financial state guarantees for UESU corporation. Rest assured that these charges are the agony and hysterics of Yanukovych, who knows that all the previous criminal cases against me fell apart and were empty political dirt, and that after the decision of the European Court of Human Rights he will have to release me. He is afraid of this because he knows that he will lose the 2015 presidential election to me and will lose everything that he amassed illegally through this "intolerable" work. He is afraid that after the elections Ukraine will no longer be his private property. He is afraid that he will have to account for all his transgressions, the violence and kleptomania, for the collapse of the foreign and domestic policies of Ukraine. He drove himself into a corner and continues to make tragic mistakes. The latest is the idea to accuse me of killing Yevhen Shcherban. Such a blatant lie won’t be hard to refute in international courts. It will be in international ones, because everyone knows the price of courts, prosecutors and investigators in Ukraine – no sense talking about this once again. I want to clearly state that UESU, which I ran until late 1996, never obtained financial state guarantees from Ukraine. Such guarantees, according to the law, are given exclusively by collegiate decision of the government and are reflected in the law on the budget of Ukraine. The government never made a collegiate decision to provide financial guarantees to UESU corporation and such a debt was never reflected in the law on the budget of Ukraine. This is easy to check, and thus the criminal case against me will be recognized as an obvious fabrication. I also want to clearly and unequivocally state that I had nothing to do with the tragic murder of Yevhen Shcherban in 1996, and this will be proved in international courts and courts in other countries. Yevhen Shcherban was one of five founders of the corporation Industrial Union of the Donbass (IUD), which controlled hundreds of enterprises privatized illegally in the 1990s. The other owners of IUD were Alexander Momot, Akhat Bragin and Rinat Akhmetov. The fifth shadow co-owner of IUD was the then young politician Viktor Yanukovych, who today is president of Ukraine. Yevhen Shcherban was the undisputed leader of this group, a member of parliament and leader of the Liberal Party of Ukraine. Within a short time, three of the owners of IUD were killed. Yevhen Shcherban and Alexander Momot were shot in Donetsk and Akhat Bragin was killed at a Donetsk stadium. After this, all the assets of IUD, estimated to be worth billions of dollars, went to Viktor Yanukovych and Rinat Akhmetov. After the tragic murder of Yevhen Shcherban, Viktor Yanukovych was able to become governor of Donetsk. The leaders of the gang that killed Yevhen Shcherban were immediately eliminated in the Donetsk penal colony, which at the time was overseen by prosecutors Kuzmin and Pshonka. What more is there to explain and what does my name have to do with the murder of Yevhen Shcherban? The internecine criminal showdowns that took place in the Donetsk oblast in the 1990s weren't rivaled by any other region of Ukraine. When Yuriy Lutsenko became the interior minister in 2005, he unearthed in one Donetsk slag heap alone more than 30 bodies of businessmen, judges, lawyers, investigators and others that were killed by the Donetsk criminal leaders in the 1990s. That is one of the reasons they have sought revenge and thrown Yuriy Lutsenko in prison. In 2005, Viktor Yushchenko told Yuriy Lutsenko to "not go digging around Donetsk slag heaps any more."Today Viktor Yanukovych decided to shift blame for the crimes he committed in the 1990s to me – his main political opponent – and try to keep me in prison for life, or maybe kill me in prison like he did with others in the 1990s. But we won’t let him do this. Viktor Yanukovych will never again be president of Ukraine, no matter how many criminal cases he brings against me. I will soon be free and Ukraine will assume its rightful place in the European family. As I write this letter, prison officials are installing another security door next to me. Why are there hundreds of riot police in camouflage and with guns guarding me? In this same way they are putting bars around freedom of speech, freedom of assembly, justice, and the right to live in Ukraine. But no matter where Yanukovych aims his guns, they will shoot to kill only at him. Hang on and believe that the worst will pass and soon everything will be different. Viktor Yanukovych’s fear is justified. But the way he’s trying to cling to power he won’t succeed, it only makes the already difficult situation worse for him. To hold on to the presidency that he so wants, you have to become a moral, incorrupt, democratic and fair European leader - political repression, tyranny, dictatorship, kleptomania and outright stupidity doesn’t lead you to the temple. Tymoshenko: today begins my personal campaign of civil disobedience Open letter from Yulia Tymoshenko to citizen of Ukraine Viktor Fedorovych Yanukovych A year and seven months ago you took me hostage and are keeping me in captivity through force and deception. With the same brute force you seized and usurped power in Ukraine and embarked on a course of Ukrainophobia and kleptocracy. Thanks to you, Ukraine almost lost its chance at becoming a European state. For four years Ukrainians have been forced to live with injustice, no freedom, humiliation and poverty. They don’t respect you – they fear you. They’re afraid that you’ll take away their jobs, businesses, freedoms and prospects for their children. The government that you embody can at any moment take with impunity everything someone has. So as to reduce public fear of your regime, so as to once again say that you’re humiliating and destroying Ukraine, I am starting a personal campaign of civil disobedience. This is my right under paragraph 5 of article 55 of the Constitution of Ukraine. Today this is the only right that I can exercise. I am publicly telling you that all of us – I, Yuriy Lutsenko, other political prisoners, the people of Ukraine – are political hostages. I believe that we don’t have the right to accept this. We are all duty-bound to stop you, Viktor Fedorovych, as soon as possible. Today I am starting my personal campaign of civil disobedience. From this moment on I no longer recognize your prosecutors and investigators. They aren’t who they claim to be. They’re not real; they’re your corrupt, amoral, politically biased criminal group, a legion of new Pukachs. Your prosecutors and investigators act in the name of Ukraine, but their anthem was and remains "Murka". For them there are no laws, no Constitution, no officer’s honor. It is wrong and unworthy of patriots of Ukraine to treat them as real prosecutors and investigators. That is why starting today I will no longer communicate with them, given them any explanations, answer their questions, or participate in any criminal proceedings that you have ordered. And it’s obvious that they’re being carried out on orders from you. Let them imitate an "honest" investigation without my participation. Secondly, from this moment, as a sign of protest, I will not voluntarily come to your court because this has long stopped being a court. It’s an inquisition without justice and honor for the 46 million citizens of Ukraine. Your pseudo-courts and pseudo- judges, Viktor Fedorovych, are rotting and they stink. There’s no point expecting justice, competence and impartiality from them. They are a legion of sweaty and gutless Kireyevs, and so there is nothing for me to do in such courts – try me without me. When you, Viktor Fedorovych, will continue the political repression against me and further spoil what remains of your political image, you will have to bring me to court using brute physical force. I will put up as much physical resistance as my strength and life will allow. This will be my personal battle against political repression, dictatorship, pseudo-judges and pseudo-courts. And lastly. From this moment I will no longer accept the humiliation by your prison officials. I will no longer let them inspect me or my personal things. I will physically defend myself, despite my illness. I will do what I can. I will not go to my prison cell until you, Viktor Fedorovych, remove the video cameras through which you follow me round-the-clock, spy on me in bed, the shower, the bathroom, stare at me as I change, eat, sleep, speak with the doctors and my lawyers. I wonder, Viktor Fedorovych, if your sons, Oleksandr and Victor, take part in these male activities with you. Ukrainian society has the right to know if the heirs to your throne are of the same moral state. I will not go into my prison hospital room until you withdraw the guards who are there illegally and who stand by my bed while I sleep or undergo medical procedures, who stand by my desk when I eat or work. I recommend that you move these guards from my bedroom to yours. I will no longer put up with your unprecedented violation of article 28 of the Constitution of Ukraine with regard to me and every person in our country. My time of patience and tolerance is over. I know that you will continue to seek your revenge, but this, Viktor Fedorovych, won’t help you. No matter what you continue doing with me, you have already lost. There is no chance to fix your political tragedy. Everyone knows your true colors. You painted your portrait and presented it to the world. It’s not a very nice portrait, but it’s sincere - like your smile. I’m sure that most Ukrainians have not accepted the humiliation that you are offering our citizens every day and that everyone will find their individual form of civil protest and disobedience. Take for example the UT-1 TV presenter who during the weather forecast found the strength to tell people the truth about your regime, or the student who hit the Ukrainophobe minister with a bouquet of flowers. Третий – от слова «зайфон», то есть «подделыватель», а имя четвертого означает «извращающий правосудие». Извращенноеправосудие – вот Содом. Тебя ограбили, но ты же еще и должен, это – Содом. Эти-то пакости мы и называем «содомом», но сам «содом», это то, что творится раньше, то есть беззаконие. Жестокость,бесчеловечие – признаки извращенного бытия. «Вы», – говорил Исайя, – «присоединяете дом к дому и выгоняете бедняка. Как будто вы одни живете на земле» Ион же говорил, что если бы Господь не сохранил Израилю остатка, то израильтяне были бы, как Содом, уподобились бы Гоморре. Ъ Бесчеловечие, обман, тотальная жестокость – вот родовые признаки Содома, и мы в нем живем. Да, к счастью, однополые забавы и половая гнусь культурно все еще далеки от нас. Но не только в этом дело. В роскоши играбеже – Содом; в злой неправде – Содом. А уж там, за высоким забором Содомского дворца, выстроенного на слезах безответных жителей земли, никто не помешает поселиться и всякому половому извращению. Так оно и бывает. Так оно и есть. Воплощенный, актуализированныйСодом, это «Колымские рассказы» Шаламова, где урка играет в карты на свитер, только что присланный с воли соседу по нарам. Урка проигрывает чужой свитер, а человек согласен снять его только вместе с кожей. Человека молча и спокойно режут насмерть, и снимают с него свитер, и продолжают дальше играть. И эта будничная картина есть картина Содома, даже не смотря на отсутствие в кадре всякого намека на педерастию. Икогда интеллигент «тискает роман» блатному авторитету, то есть, стоя на цырлах по понятиям излагает смысл классического произведения, будь то «Ромео и Джульетта» или «Фауст» блатному авторитету, то это тоже Содом. Этот несчастный интеллигент может еще и, рассказывая, пятки чесать этому самому авторитету, зарабатывая часть блатной пайки, и это уже совсем сравнить не с чем. Педерастии может не быть, а Содом есть, и он очевиден. Этоне апология половых извращений. Да не будет! Этопопытка расширить понимание проблемы до ее истинных размеров, а не до локальных границ, установленных произвольно. Содом – не просто извращенный блуд, но целиком извращенная жизнь, и лишьтогда, как неизбежный плод ее, извращенная половая жизнь. Ибо, как и остаться неизвращенной половой сфере жизни, если вся жизнь вообще извращена?

On Friday, 20 April, 2012, after the end of the working day, conclusions of the German doctors, Professor Karl Maks Einhäupl and Norbert Haas, were conveyed to me. In the collusions, it was said that I would be unable to restore my health in the hospital proposed by Ukraine's government.
The reason is not in doctors - I trust Ukrainian doctors and respect them deeply because I know about the difficult conditions they work in - and not in the equipment of the hospital, as it in line with standards. The reason is the general situation of every-minute violence and cruel treatment organized for me by the current president of Ukraine.
After having received conclusions of the German doctors I informed the colony's head in writing, and supervising prosecutor and deputy minister of health verbally that, taking into account the contents of the conclusions, I was unable to go to the hospital until I meet with my defense counsel. We agreed that the transfer to hospital would take place on Monday after I talk to Serhiy Vlasenko.
But around 21:00, my neighbour was made to go out of the prison cell, and later three sturdy men came into the cell. They approached my bed, threw a bed-sheet over me and began to drag me off the bed three together applying brutal force. In pain and despair I started to defend myself as I could and got a strong blow in my stomach through the bed-sheet, they wrung my arms and legs, lifted me and dragged in the bed-sheet into the street. I thought these were the last minutes of my life. In unbearable pain and fear I started to cry and call out for help, but no help came. At some moment I fell unconscious because of awful pain and came back to consciousness in a hospital ward. Being extremely stressed, I refused to talk to anyone until I see my defense counsels. The next day I refused to take food. But there was no meeting with my defense counsels. I think about the helplessness and hopelessness every person feel today when they confront with the government's violence in all its manifestations. When they started to apply brutal force to me I imagined the despair of the defenseless people being cruelly, brutally beaten and sometimes even killed by policemen at numerous prisons, pre-trail detention centers, militia stations, colonies, in basements of the modern SBU-NKVS. When you are within four closed walls, fully-isolated from the world, when butchers with distorted from fury faces "take care" of you, when you do not know if this is the end of your life, only then you realize clearly what country we have built over 20 years of our independence, and you understand that we do not have the right to leave it to our children in this inhuman condition.
I stopped taking food on 20 April with one aim - to draw attention of the democratic world to things happening in the centre of Europe, in the country named Ukraine. The question is not the destiny of modern political prisoners: we are ready to go our way, whatever it may be, decisively and with dignity. The problem is different - the problem is to understand immediately that the president of Ukraine is steadily and pedantically building a concentration camp of violence and lack of rights in the great and European Ukraine, supplemented by an unprecedented enrichment of the ruling family and its entourage by means of misappropriating state resources. We must realize without delay the tragic state of affairs and stop this immediately using all Ukrainian and international means and influence. If we lose time we will get a new Libya or Syria in the centre of Europe, and then it will be late to extinguish the fire.
I beg the democratic world and all healthy forces within Ukraine to start acting immediately and with joint efforts to eliminate this all-European threat. I say eliminate because conservative treatment is already impossible in this case.
I propose the following plan consisting of two points: first, to commence public international investigations into all corruption dealings of the Yanukovych family and its entourage involving international transaction and registering of illegally obtained assets on the territory of foreign states.
I publicly ask all honest journalists, leaders of civil movements, officials, representatives of law-enforcement agencies and other people who are not indifferent to convey me materials of journalist and other investigations that clearly prove international character of the crimes committed by Ukrainian authorities. I publicly appeal to official governments of the countries in jurisdiction of which our rulers have committed their corruption crimes with a request to conduct unbiased independent investigations into these crimes and to prosecute the guilty people. We must begin the Great Cleaning of the country now.
Second, we must do everything possible to remove the Yanukovych regime with all its metastasises in the parliamentary elections, without any revolutions and in peaceful manner. In the nearest time, I will publish an appeal to all citizens of Ukraine explaining how we could do this. If in the parliamentary elections the people of Ukraine are prevented from removing the government it means that we will have to start a new peaceful revolution. The one thing we must not do is to be a silent herd taken to the slaughter. I will oppose this till I am alive. And I know that you will not let them humiliate Ukraine like this...

Lawyer Serhiy Vlasenko says the High Specialized Court of Ukraine for Civil and Criminal Cases, which in under two months will consider Yulia Tymoshenko's cassation appeal, has grounds to cancel the illegal sentence delivered on October 11, 2011 in the so-called "gas case" on the basis of the results of an independent evaluation of the ex-premier's signature.
"An expert analysis was performed on March 5, 2012 at the request of the defense team. This analysis established the following: "The directives to the Naftohaz Ukraine delegation for negotiations with Gazprom from Jan. 19, 2009" do not contain Tymoshenko's personal signature, but a facsimile. Therefore, everything that Tymoshenko stands accused of -that she allegedly signed something - is refuted by the findings of the independent experts, which the defense spoke about during the trial in the Pechersk court. We have an independent conclusion. Given this, the High Specialized Court for Civil and Criminal Cases has no other choice but to cancel the shameful verdicts by the Pechersk court and appeals court and establish that Tymoshenko did not break the law," Serhiy Vlasenko said at a press conference today in Kyiv.
Serhiy Vlasenko said the analysis and response to the letter from the defense team was signed by Oleksandr Krut, expert and director of the Alternatyva Center of Forensic Examinations. "The defense obtained the latest irrefutable evidence that there was no fault in Tymoshenko's actions, as well as documents that clearly establish that the analysis that was the only proof of Tymoshenko's alleged guilt was incorrect," he stressed.
"There is no other evidence in the case. There is no other document that confirms Tymoshenko's guilt, and there is also no document called a 'directive' personally signed by her," he added.
Serhiy Vlasenko also noted that the case filed contains the opinion of Justice Minister Oleksandr Lavrynovych, who said decisions of the Cabinet of Ministers weren't necessary for the signing of gas contracts with Russia in 2009. "But Mr. Azarov, like a parrot, continues to repeat that a cabinet decision was needed. I understand that Mr. Azarov is a better lawyer than Mr. Lavrynovych, but let Mr. Azarov continue to deal with cabbage - in the direct meaning of this word," he said ironically.
"The issue of Tymoshenko's disease is important and she must be saved because I believe the authorities are doing everything to artificially destroy her health. However, the issue of Tymoshenko's innocence of the crime she was charged with is far more important," he concluded.
At 10 am on May 15, 2012, the High Specialized Court of Ukraine for Civil and Criminal Cases will consider Yulia Tymoshenko's appeal of her conviction and sentence in the so-called "gas case".

I will not analyze the judge's decision in this case because the absurd can't be analyzed. All of Ukraine and the world sees who is in power in Ukraine, who orders political judgments.
I want to say something else -the day Yuriy Lutsenko was sentenced is the day a sentence was passed against the Yanukovych regime.
They throw us behind bars, but they fear us even more.
They hide us in jails, but their primal instinct tells them their days are numbered.
They fabricate cases against us, but they know that a real judgment is being written against them in that higher court where there are no Vovks or Kireyevs.
Because no matter what they do, they will never put the whole nation behind bars, never deceive, never intimidate everyone.
By announcing a judgment against us they are getting a judgment from which they can't hide, regardless of the walls, fortresses and residencies they build for themselves.
Their end will come soon. And it won't come abroad. Their disgraceful end will come from Ukraine: from Lviv and Donetsk, from Odessa and Poltava, from Chernihiv and Kharkiv.
Today we are behind bars. But if this is the price we must pay for the country's liberation, then we are willing to pay it. Yuriy, I know that you agree with me.
Thank you, Yuriy, for your patience, your courage, your honor, your strength, you dignity. Thank you for remaining a true man in the face of the weak fools who tried to judge you.

Yulia #Tymoshenko expands list of defendants in lawsuit against #RosUkrEnergo

Former Prime Minister Yulia Tymoshenko has expanded the list of defendants in her lawsuit filed in a U.S. Court against RosUkrEnergo, adding the company's owner, Dmytro Firtash, Minister of Fuel and Energy Yuriy Boyko, SBU Chairman Valeriy Khoroshkovsky, and Prosecutor General Viktor Pshonka.
Yulia Tymoshenko signed the amended complaint on December 13, 2011 and it was filed on December 19.
The list of defendants also includes Semyon Mogilevich, who is on the FBI's most wanted list, Paul Manafort, Viktor Yanukovych's American political adviser, First Deputy Prosecutor General Renat Kuzmin, Oleksandr Nechvoglod who was in charge of the pre-trial investigation in the "gas case", and prosecutor Lilia Frolova, who represented the prosecution in the trail against Yulia Tymoshenko.
The complaint, published by the Kyivpost, alleges that the political persecutions in Ukraine are part of a larger complex racketeering scheme, involving the laundering of money in the United States and abroad, and the payment of illegal kickbacks to Ukrainian government officials.
The complaint accuses the defendants of working "both inside and outside of government channels for the purpose of unjustly enriching themselves at the expense of Ukrainian citizens."

Oleksandr Turchynov, the first deputy head of the Batkivshchyna Party, says the Ministry of Health, on orders from the presidential administration, is deliberately covering up and manipulating information about the true state of Yulia Tymoshenko's health.
"Ukraine's leadership is trying to physically destroy Yulia Tymoshenko behind barbed wire," Oleksandr Turchynov told the press today.
According to him, today they finally obtained objective information about events that took place at the Kachanivska prison colony on January 6. He said that at approximately 22:30on January 6, Yulia Tymoshenko lost consciousness immediately after taking medication for an acute respiratory infection.
"For 20 minutes the woman who shares the cell with Yulia Tymoshenko knocked on the door to get medical staff. They opened the door after 20minutes and the guards called the prison's medical staff, who began resuscitation and only after midnight were able to being Yulia Tymoshenko back to life. The whole time her blood pressure was 60/40," he said.
Oleksandr Turchynov also said that Ministry of Health physicians were summoned to the prison later. "At night they had a meeting and decided to urgently, in the morning, examine her in a clinical setting. Therefore, on the morning of January 7, a clinical examination was conducted. Lawyer Serhiy Vlasenko says Yulia Tymoshenko's conviction in the so-called "gas case" will be an additional argument for the ex-premier's case in the New York court against Swiss company RosUkrEnergy and its co-owner Dmytro Firtash.
"The lawsuit claims that a mafia group was created in Ukraine that usurped power in Ukraine. And the arrest, repeat arrest of Tymoshenko, and the verdict in the case are only additional arguments that confirm the situation, they are additional arguments to justify our claim," Serhiy Vlasenko said at a press conference today in Kyiv.
Serhiy Vlasenko added that Yulia Tymoshenko's lawsuit against RosUkrEnergo and its co-owner can't begin in the American court because Dmyto Firtash hasn't been given the proper summons. "The problem with the case involving Firtash is that he has to be served a summons, and there's a problem with this. The summons can be served in this situation only according to procedures outlined in the Hague Convention. Unfortunately, this takes time. The American court isn't the Pechersk District Court, which can say that they sent a summons by fax, telex, or some other way. There, everything is tied to a particular procedure," he said.
