Contract Law and Tourism

The message in my previous posting about the puppy is especially important for tourists. If you do not like your hotel room or your meal, you have to let them know right away. Give notice or notification, as the contract law expresses it. They then have a chance to give you a new room or serve you another plate.

If you do not let the hotel or the restaurant have the opportunity to correct their mistakes, you can not expect to get any money back when you are back home. As CISG says it for sale of goods; when it is not unreasonable the seller has a right to remedy the lack of conformity by repair or by substitute goods.

"Article 48
(1) Subject to article 49, the seller may, even after the date for delivery, remedy at his own expense any failure to perform his obligations, if he can do so without unreasonable delay and without causing the buyer unreasonable inconvenience or uncertainty of reimbursement by the seller of expenses advanced by the buyer. However, the buyer retains any right to claim damages as provided for in this Convention."

The puppy was bought. The puppy was delivered. A few days later the puppy died.More about remedying
